Contractor means Kaylina Electrics and its employees, contractors and authorised representatives.
Service means the smoke alarm inspection and/or electrical safety check booked by the Client.
Client means the property owner, managing agent, tenant or authorised representative engaging the Contractor.
2.1 The Contractor will conduct a visual inspection and standard electrical testing of accessible electrical installations and smoke alarm systems at the property.
2.2 The Service is a point-in-time safety check only and reflects the condition of the installation at the date and time of inspection.
2.3 The Service is carried out in accordance with applicable Australian Standards and Victorian electrical safety legislation current at the time of inspection.
2.4 The Service does not include:
• Inspection of concealed wiring within walls, ceilings, floors or underground
• Destructive testing
• Inspection of non-accessible areas
• Testing of unplugged portable appliances
• Solar, battery, EV charging, data, telecommunications or security systems unless specifically agreed in writing
• Full switchboard upgrades or rewiring assessments
2.5 The Contractor is not required to move furniture, stored goods, insulation, fixtures or personal belongings. Areas that are unsafe or inaccessible will be noted in the report.
3.1 A written report will be provided identifying tested items and any non-compliance observed at the time of inspection.
3.2 Any rectification works are not included in the inspection fee and will be quoted separately.
3.3 Rectification works will only be carried out with the Client's express approval.
3.4 Where the Client declines recommended rectification works, the Contractor accepts no liability for risks, faults, damage or incidents arising from those declined works.
4.1 If an electrical component fails during testing, the Contractor will take reasonable steps to obtain authorisation prior to carrying out repairs.
4.2 If authorisation cannot be obtained within 15 minutes and the installation is unsafe or without electrical supply, the Contractor may perform the minimum necessary work required to restore the installation to a safe and functional condition.
4.3 All emergency works performed under clause 4.2 will be invoiced separately at the Contractor's standard rates and are payable by the Client.
5.1 The Client warrants that they are authorised to engage the Contractor.
5.2 The Client must ensure safe and unrestricted access to all relevant areas including switchboards and smoke alarms.
5.3 If the Contractor attends and access is not available, a rebooking fee of $50 (excl. GST) will apply.
5.4 The Client must disclose any known electrical hazards, faults or access limitations prior to inspection.
6.1 Electrical installations may be aged, brittle or deteriorated. Minor cosmetic damage such as paint disturbance, small plaster cracking or insulation movement may occur during reasonable inspection activities.
6.2 The Contractor is not liable for minor cosmetic damage resulting from necessary inspection or testing where installations are aged or defective.
7.1 The Contractor may take photographs or video recordings of the installation for documentation, compliance and evidentiary purposes.
7.2 Such records remain the property of the Contractor.
8.1 The inspection fee is fixed as quoted at booking.
8.2 Payment is due in full prior to commencement of the Service unless otherwise agreed in writing.
8.3 Additional works are charged separately.
8.4 Overdue invoices incur interest at 10% per annum and the Client is liable for all reasonable debt recovery costs.
9.1 The report reflects the condition of the installation at the time of inspection only.
9.2 Electrical systems may deteriorate, be altered, damaged or interfered with after inspection. The Contractor is not liable for faults or incidents arising after the inspection date.
9.3 The Contractor is not liable for:
• Third-party interference
• Subsequent alterations
• Undisclosed hazards
• Concealed defects
• Wear and tear or environmental damage
9.4 To the maximum extent permitted under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the Contractor's total liability arising from the Service is limited to the fee paid for that Service.
9.5 Nothing in these terms excludes any consumer guarantee that cannot lawfully be excluded.
The Client indemnifies and holds harmless the Contractor against any claim, loss, damage or expense arising from:
• Third-party interference
• Declined rectification works
• Undisclosed hazards
• Alterations made after inspection
• Misuse of the installation
All work is carried out by a licensed electrician in accordance with Victorian regulations and applicable Australian Standards.
The Contractor is not liable for delays or failure to perform due to events outside reasonable control including power outages, extreme weather, supplier delays or government action.
Personal information is handled in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
These terms are governed by the laws of Victoria, Australia.
